The agreement, in plain terms.
These terms cover using QuickDesk to run your support desk. They are written in plain language on purpose: you should be able to read the whole thing and know where you stand.
Who this is between
This agreement is between QuickDesk, which provides the chat widget, shared inbox and support tooling at quickdesk.co.uk, and the business or person who creates a QuickDesk workspace. In these terms "you" means that business, and "we" means QuickDesk.
What you can expect from us
- The service as described on the site, kept running with reasonable care and skill.
- Your data handled as set out in our privacy notice, including keeping your customers' conversations confidential.
- Notice of material changes to these terms or to what a plan includes, sent to the email on your account.
We do not promise the service will be uninterrupted or error-free. Maintenance happens, and so do faults; we fix them as quickly as we reasonably can.
What we expect from you
- Use QuickDesk lawfully, and do not use it to send unsolicited bulk messages or anything abusive, misleading or illegal.
- Keep your sign-in details and API keys to yourself, and tell us promptly if you think an account has been compromised.
- Tell your own customers what you are doing with the messages they send you. For those conversations you are the data controller and we handle them on your behalf.
- Do not attempt to break, overload or reverse engineer the service, or resell it as your own without a written agreement with us.
Plans, payment and trials
Paid plans are billed in advance, monthly or yearly, at the price shown on the pricing page when you subscribe. A free trial runs on the plan you chose and becomes a paid subscription when it ends unless you cancel first. Where a plan includes usage limits, such as seats or conversations, we will tell you before charging for anything beyond them.
You can change or cancel your plan yourself from the Billing page at any time. Cancelling stops future charges; we do not refund the part of a period you have already paid for unless the law says otherwise or we have got something badly wrong.
Your data, and closing your account
Your content stays yours. You can export or delete it while your workspace is open, and you can close the workspace from Account settings whenever you like.
When a workspace closes, or a subscription lapses, we keep the data for 30 days so you can come back by subscribing again. After that window it is deleted. If you want it removed sooner, ask us and we will do it.
Ending the agreement
You may stop using QuickDesk at any time by closing your workspace. We may suspend or end an account that breaks these terms, that has not paid, or that puts the service or other customers at risk. Where it is reasonable to do so, we will warn you first and give you a chance to put it right.
Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, neither side is liable for indirect or consequential loss, or for lost profits, revenue or data; and our total liability in any twelve month period is limited to the fees you paid us in that period.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
